By accessing or using the website, platform, tools, or any services provided by Docere Immigration ("Company," "we," "us," or "our"), including but not limited to our form-filling guidance tools, educational resources, and any communications with our team, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms of Service, you must immediately discontinue use of our website and services. Your continued use of any part of our services constitutes your acceptance of these terms as they may be amended from time to time.

Docere Immigration is a private technology platform that provides general educational guidance and tools to help users navigate immigration form-filling processes. We are not licensed by the College of Immigration and Citizenship Consultants (CICC), we are not Regulated Canadian Immigration Consultants (RCICs), we are not Regulated International Student Immigration Advisors (RISIAs), and we do not hold any license or authorization to provide immigration advice or legal representation under the College of Immigration and Citizenship Consultants Act or any other Canadian law.

No employee, contractor, agent, or representative of Docere Immigration is authorized to provide legal advice, immigration advice, or to act as your legal or immigration representative in any capacity whatsoever. Our services do not create any attorney-client, consultant-client, advisory, or fiduciary relationship between you and Docere Immigration.

Docere Immigration is a private company and has no affiliation with Immigration, Refugees and Citizenship Canada (IRCC), the Canada Border Services Agency (CBSA), the College of Immigration and Citizenship Consultants (CICC), or any other government agency or regulatory body. You are not required to use Docere Immigration to complete government forms.

You are strongly encouraged to consult with a licensed Regulated Canadian Immigration Consultant (RCIC), a member of the Barreau du Québec, or another qualified legal professional before making any immigration-related decisions.

Description of Services

Docere Immigration provides a technology-based platform designed to:

  • Guide users through the process of filling out immigration-related forms
  • Help pre-fill certain form fields based on information you provide
  • Provide general educational information about Canadian immigration processes and requirements
  • Offer tools to organize and review your application documents

Our services are strictly limited to the above. Specifically, Docere Immigration does NOT:

  • Provide legal advice or immigration consulting services
  • Act as your representative before IRCC, CBSA, or any government authority
  • Submit immigration applications on your behalf
  • Guarantee or influence the outcome of any application
  • Replace the services of a licensed immigration consultant or lawyer
  • Make decisions on your behalf regarding immigration strategy

All forms completed through our platform are self-prepared and self-submitted by you. You are the applicant, and you are solely responsible for the accuracy, completeness, and submission of your own applications.

No Legal or Immigration Advice

No information, guidance, suggestion, recommendation, or communication provided by Docere Immigration — whether through our website, platform, emails, chat messages, phone calls, video calls, social media, in-person interactions, or any other medium — constitutes legal advice, immigration advice, or professional consulting of any kind.

All information and guidance provided through our services is general in nature and is intended solely for educational and informational purposes. Such information should not be relied upon as a substitute for professional legal or immigration advice tailored to your specific circumstances.

Any interaction with our team, including but not limited to customer support communications, guidance sessions, follow-up emails, platform notifications, or educational content, is provided for general informational purposes only and does not create any professional advisory or fiduciary relationship. You acknowledge that no such communication can give rise to any claim, liability, or cause of action against Docere Immigration.

No Guarantee of Outcomes

DOCERE IMMIGRATION MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE OUTCOME OF ANY IMMIGRATION APPLICATION, PERMIT REQUEST, VISA APPLICATION, OR ANY OTHER GOVERNMENT PROCESS.

You acknowledge and agree that:

  • All immigration decisions are made solely and exclusively by government authorities, including but not limited to IRCC and CBSA
  • Using our platform does not improve, guarantee, or otherwise influence the likelihood of approval of any application
  • Past results or success stories referenced on our website or in our communications do not guarantee or predict future outcomes
  • Processing times, requirements, and policies are determined by government authorities and may change without notice
  • Docere Immigration has no control over, and accepts no responsibility for, any decision made by any government authority

Docere Immigration shall not be held responsible or liable for any denial, delay, rejection, request for additional information, or any other adverse decision or outcome by IRCC, CBSA, or any other government authority, regardless of whether you used our services in connection with your application.

  • You will comply with all applicable Canadian and international laws and regulations
  • You will not use our services for any fraudulent, unlawful, or unauthorized purpose
  • You will maintain the confidentiality of your account credentials
  • You will notify us immediately of any unauthorized use of your account

Accuracy of Information

You are entirely and solely responsible for the accuracy, completeness, and truthfulness of all information you provide through our platform. Docere Immigration relies on the information you provide and does not independently verify its accuracy.

You must carefully review all forms, documents, and pre-filled information generated through our platform before submission to any government authority. It is your responsibility to ensure that all information is correct and complete. Docere Immigration accepts no responsibility for errors, omissions, or inaccuracies in the information you provide or in forms you submit.

Providing false, misleading, or incomplete information to government authorities may constitute a criminal offence and may result in the denial of your application, a ban from future applications, or other penalties. Docere Immigration bears no liability for any consequences arising from inaccurate or incomplete information provided by you.

Account and Access Restrictions

Your account and access to our platform and services are personal to you and are non-transferable. You may not share, transfer, sell, lend, assign, sublicense, or otherwise make available your account credentials, platform access, or any documents, forms, pre-filled templates, or materials generated through our services to any other person or entity, whether for commercial or non-commercial purposes.

Each account is intended for use by a single individual for their own immigration application(s). You may not use your account to prepare, assist with, or submit applications on behalf of any third party. If you require services for additional individuals (such as family members), each person must have their own separate account and service agreement.

Any unauthorized sharing, distribution, or transfer of your account access or platform-generated materials constitutes a material breach of these Terms and may result in:

  • Immediate termination of your account without refund
  • Revocation of access to all platform services and materials
  • Legal action to recover damages, including but not limited to lost revenue and enforcement costs
  • Liability for any harm caused to Docere Immigration or third parties as a result of the unauthorized sharing

You are responsible for all activity that occurs under your account, whether or not you authorized such activity. Docere Immigration reserves the right to monitor account usage for compliance with these restrictions and to suspend or terminate accounts that violate these terms.

Fees and Payment

Certain services offered by Docere Immigration require payment of fees. All fees are quoted in Canadian Dollars (CAD) unless otherwise specified. The applicable fees for each service will be clearly communicated to you before you engage our services.

All fees are non-refundable once services have been rendered, except as required by applicable law. By purchasing our services, you acknowledge and agree that fees paid are for access to our platform tools and educational guidance, and are not contingent on any particular outcome of your immigration application.

We reserve the right to modify our fees at any time. Any fee changes will be communicated to you in advance and will not affect services already purchased.

Intellectual Property

All content on our website and platform, including but not limited to text, graphics, logos, images, software, tools, and educational materials, is the property of Docere Immigration and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

Confidentiality and Data Sharing

We maintain strict confidentiality regarding your personal information. Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that we may need to use third-party service providers (such as cloud hosting, email services, and payment processors) to deliver our services, and that your information may be shared with such providers as necessary. We will never sell your personal information to third parties.

Disclaimer of Warranties

OUR WEBSITE, PLATFORM, TOOLS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

Without limiting the foregoing, Docere Immigration does not warrant that:

  • Our services will meet your specific requirements or expectations
  • Our services will be uninterrupted, timely, secure, or error-free
  • The information provided through our services will be accurate, complete, or current
  • Any errors in our platform or services will be corrected
  • Our platform will be free of viruses or other harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCERE IMMIGRATION, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) OUR WEBSITE, PLATFORM, OR SERVICES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF DOCERE IMMIGRATION TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO DOCERE IMMIGRATION DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY CANADIAN DOLLARS (CAD $50.00), WHICHEVER IS GREATER.

These limitations of liability apply regardless of the legal theory on which the claim is based, including contract, tort (including negligence), strict liability, or any other theory, and whether or not Docere Immigration has been advised of the possibility of such damages.

Without limiting the generality of the above, Docere Immigration shall have no liability whatsoever for any immigration application denial, delay, or adverse outcome, any errors in government forms or applications, any changes in immigration laws, policies, or processing times, or any actions or decisions by government authorities.

Indemnification

You agree to defend, indemnify, and hold harmless Docere Immigration, its owners, officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney and legal fees) arising out of or in connection with:

  • Your use of our website, platform, or services
  • Your violation of these Terms of Service
  • Your violation of any applicable law or regulation
  • Any information you provide through our platform
  • Any immigration application or government process in which you used our services
  • Your negligence or willful misconduct
  • Any claim by a third party related to your use of our services

Third-Party Services and Links

Our website and services may contain links to third-party websites, services, or resources. Docere Immigration does not endorse, control, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

Termination

We reserve the right to terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including but not limited to breach of these Terms of Service. Upon termination, your right to use our services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to the disclaimer, limitation of liability, indemnification, and governing law sections.

18.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms of Service or your use of our services shall first be attempted to be resolved through good-faith negotiation between the parties for a period of thirty (30) days.

If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration administered in Montreal, Quebec, in accordance with the applicable arbitration rules of the Province of Quebec. The arbitration shall be conducted in English or French, as agreed by the parties. The arbitrator's decision shall be final and binding.

Notwithstanding the above, either party may seek injunctive or other equitable relief in the courts of the Province of Quebec. You agree that any judicial proceedings shall be brought exclusively in the courts located in Montreal, Quebec, and you consent to the jurisdiction of such courts.

19.

Governing Law

These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

20.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Docere Immigration regarding your use of our services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time at our sole discretion. We will notify you of material changes by posting the updated terms on our website and updating the "Last Updated" date at the top of this page. Your continued use of our services after the posting of revised terms constitutes your acceptance of the updated terms. It is your responsibility to review these Terms periodically.
